Response -The statement has been revised as per DRMS suggestion. <br />10. Table 2.05.3-3 describes the general timing of operations at the NHN Mine. Please add <br />the anticipated construction and reclamation of the Equipment Corridor and any <br />necessary utility relocations to this list. <br />Response -Anticipated construction and reclamation timing for Equipment Corridor <br />and utility relocations have been added. <br />2.05.3(3) - Mine facilities <br />1. Page 3 of Section 2.05.3(3) contains a general discussion of Support Facilities and Utility <br />Installations. Please provide a map, in accordance with Rule 2.10.3, which depicts the <br />facilities at a scale sufficient to see the various buildings, utilities, and intersection of the <br />haul road with the County Road at the southern edge of the permit area. <br />Response - The requested information is provided in Map 2.05.3(3)-3. <br />2. In the Fuel Storage section, please include the tanks used to store used oil for use in heating <br />the truck shop (if such a facility is proposed here, as is found at the NH2 Mine). <br />Response - The tanks to store used oil are added in the Fuel Storage section. <br />3. Rule 2.05.3(3)(c)(v) requires a description of measures to be used to ensure that the interests <br />of the public and landowners affected are protected if the applicant seeks Division approval <br />of conducting the proposed surface mining activities with 100 feet of the right-of-way line <br />of any public road, except where mine access or haul roads join that right-of-way. The <br />Division understands that for the Special Use Permit, WFC has requested approval to <br />disturb the ground surface to within 25 feet of the County's right-of-way. Please <br />incorporate this information into the text and map(s) of the PAP. <br />Response -A statement requesting disturbance within 25 feet of Montrose County right- <br />of-way has been added in the text. The Montrose County Special Use Permit allows <br />disturbance for roads and ditches within 25 feet of the County right-of-way but mining no <br />closer than 100 feet from the County right-of-way. <br />4. On Page 15 of Section 2.05.3(3), in the County Roads section, please add the phrase, "the <br />outside right-of-way of immediately prior to "current public roads." <br />Response - The recommended phrase has been added <br />5. The Division has several comments regarding Map 2.05.3(3)-2 - Haul Road Alignment and <br />Details: <br />a) No Legend has been provided. Please provide a Legend that identifies all features and <br />symbols. <br />Response - Legend has been added in Map 2.05.3(3)-1. <br />Response to First Adequacy Review Page 31
