Pineda <br /> Director <br />RE: Reclamation Liability Update, Corey Pit # 3, Montrose County, Permit No. M-1987-024 <br />Dear Ms. DeVincentis: <br />The Colorado Land Reclamation Act for the Extraction of Construction Materials and Permit M-1987-024 <br />require you to maintain a financial warranty in good standing for the entire life of the permit. On June 10, <br />2011 the financial warranty for this permit is canceling. A replacement financial warranty in the amount of <br />$63,000.00 was required to be filed with us by May 11, 2011. To date, we have not received a <br />replacement financial warranty. <br />It is staff understanding that a Succession of Operator (SO) may be being contemplated. Please note that <br />the SO or replacement warranty must be completed by June 24, 2011 in order to avoid a hearing before <br />the Mine Land Reclamation Board (MLRB). If the SO is not completed by that time there is no recourse <br />under the rules or Act for a new operator to lift a revocation or forfeiture of a past operator. The Division <br />would have no choice but to revoke the permit, forfeit Western's bond, and reclaim the site. A new <br />permit application to continue mining would be required to continue mining at the site by someone else if <br />the Western Gravel permit is revoked. <br />The Division inspected the site on May 5`h, 2011. During the inspection it was observed that 12 acres are <br />currently disturbed. An update of the reclamation liability was done to account for the current conditions. <br />The update shows the $63,000.00 required bond will cover only the current disturbance.
