' Colowyo Response - PR3 adequacy No. 2 May 6, 2011 2.04.11(2), the applicant shall contact the Division to determine what fish and wildlife resources information will be required. While it appears that a thorough fish/wildlife study and report of the Collom Permit Area are included in the permit, there is not a discussion in the text about a pre-study meeting with the Division to determine the required data for the study. The Division feels that Colowyo's response is adequate; however, please incorporate into the permit text that the Division deferred to CDOW for creating a scope of work. Also include CDOW's letter approving Cedar Creek's scope of work for the Collom Expansion Area. Colowyo 's Response: Colowyo has amended Rule 2 Section 2.04.11(1-3) as requested and also included the letter from CDOW approving the scope of work completed for baseline wildlife data collection in the Collom Expansion Area. 2. Incorporate the findings from the CDOW (letter dated Feb 17, 2011) into the text to add the wildlife baseline knowledge of the Collom Expansion Area. " Item Resolved Rule 2.04.12 Prime Farmland Investigation 1. In Section 2.04.12 of the application, CCC states that the USDA-Natural Resource Conservation Service (MRCS) made a negative determination in 2002 regarding the presence of prime farmland in the permit expansion area. Please provide documentation, for inclusion into the permit, from the NRCS regarding the negative determination of prime farmland.JHB CCC provided 3 copies of a letter from NRCS, Craig Field Office, dated March 23, 2011, stating that the NRCS has made a negative determination for the existence of Prime Farmlands within the proposed Collom Expansion Area Permit Boundary (PR3). This response is acceptable. CCC, however, has not designated where in the permit this letter should be included. Please instruct the Division as to placement of the NRCS letter into the permit. Colowyo's Response: Colowyo requests that the Division place this letter in the back of Exhibit 9 Item 9 created as a result of Colowyo's March 25, 2011 PAR response package. 2. Section 2.04.12 page 84 has been mis-numbered. The Division believes this should be labeled "Rule 2, Page 87". Please correct it accordingly.JHB CCC has revised and resubmitted text. Page numbers have been corrected. This response addresses the Division's request. Rule 2.05 - Operations and Reclamation Plan : Colowyo Coal Company has informed the Division that significant changes to the mine plan for the Little Collom X pit are anticipated. The Division has reviewed the original (1/23/2009) Operations and Reclamation plan submitted by Colowyo and has questions more general in nature.
