Jacob Bauer, Martin and Wood <br />May 20, 2011 <br />Page 3 <br />acre-feet for the period January 2011 - December 2011, and 26.47 acre-feet for the period <br />January 2012 - December 2012. <br />The St. Barbara Sand and Gravel Mine operation possesses a corporate surety bond in <br />the amount of $410,693 held with the Division of Reclamation, Mining, and Safety. The amount <br />is available to cover the cost to line or backfill the pit in the event the operator abandons the <br />project and/or allows the dewatering operation to discontinue. <br />CONDITIONS OF APPROVAL <br />I hereby approve the proposed substitute water supply plan in accordance with §37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan shall be valid through December 31, 2012 unless otherwise revoked or <br />modified. <br />2. If this plan will not be made absolute by a water court action by the plan's expiration date, <br />a renewal request must be submitted to this office with the statutory fee (currently $257) <br />by November 15, 2012. <br />3. The maximum amount of ground water exposed shall not exceed 9.76 acres, in <br />accordance with Permit No. 62251-F. Documentation of pond size may be required by <br />the Division Engineer in the form of an aerial photo evaluation or survey by a <br />Professional Land Surveyor during the plan year or years covered by subsequent <br />renewals of this plan. <br />4. The maximum annual evaporative loss associated with this mining operation shall not <br />exceed 25.23 acre-feet under Scenario A and shall not exceed 26.19 acre-feet under <br />Scenario B, as listed on the attached Tables 1A and 1B. <br />5. Under Scenario A, the maximum operational loss associated with this mining operation <br />shall not exceed 1.30 acre-feet, as listed in on the attached Table 1A. The total product <br />mined at the St. Barbara Sand and Gravel Mine shall not exceed 25,000 tons per year <br />resulting in an annual amount of 0.74 acre-feet of water lost in the mined aggregate. The <br />annual amount of water used for dust suppression shall not exceed 0.56 acre-feet. <br />Under Scenario B, there shall be no operational loss associated with this mining <br />operation. <br />6. Total consumption at the St. Barbara Sand and Gravel Mine shall not exceed the <br />aforementioned amounts, totaling 26.53 acre-feet per year under Scenario A and 26.19 <br />acre-feet under Scenario B, unless an amendment is made to this plan. <br />7. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. Any future historic consumptive use credits <br />sought for this site (e.g., agricultural water transfer) must consider all previous credits <br />applied. <br />8.
