Mr. Frank Healy Page 2 <br />4/28/2011 <br />Stream Depletions <br />The gravel pit is located about 300 feet north of the Arkansas River. A Glover analysis <br />was used to estimate the timing of stream depletions. A stream depletion factor of 7.5 days was <br />taken from "Stream Depletion Factors, Arkansas River Valley, Southeastern Colorado" by C.T. <br />Jenkins and O. James Taylor (USGS OFR 72-192). Steady state conditions were assumed and <br />the monthly water uses estimates from Table 1A (attached) were used. <br />Replacement of Stream Depletions <br />Based on the present share yield of 1.0 acre-feet per LAWMA share, All-Rite proposes <br />to use a portion of the 36 LAWMA shares leased during LAWMA's 2010 water year as the <br />source of replacement water for the period January 1, 2011 through March 31, 2011. The <br />agreement between All-Rite and LAWMA for the administration and accounting of the <br />replacement water is attached. All-Rite proposes to use a portion of the 40 acre-feet of fully <br />consumable water leased from AGUA over AGUA's 2011 water year for the period April 1, 2011 <br />through December 31, 2011. Together, these two supplies are to provide 36 acre-feet of <br />replacement water for this plan year from January 1, 2011 - December 31, 2011. <br />Accounting <br />The attached Table 1 B is the monthly accounting form that will be used for determining <br />water use and stream depletions. All-Rite will submit the monthly pit area, product mined, and <br />diversions from-the pit for dust suppression to LAWMA/AQUA, which will then submit the <br />monthly water accounting to the Division Engineer. <br />Conditions of Approval <br />I hereby approve the proposed substitute water supply plan in accordance with Section <br />37-80-120, C.R.S., subject to the following conditions: <br />1. Total consumptive losses of 35.06 acre-feet, of which 2.0 acre-feet will be used for dust <br />suppression from the pit, 1.5 acre-feet will be hauled away as product moisture, and <br />31.56 acre-feet will evaporate from the pit's water surface, shall not be exceeded during <br />the period of time that this plan is in effect. Should the total consumptive use at the pit <br />exceed 35.06 acre-feet per year prior to the expiration of this plan, an amendment will <br />need to be filed with this office. <br />2. Adequate accounting of depletions and replacements must be provided to the Water <br />Commissioner and/or Division Engineer on a monthly basis or other interval acceptable <br />to both of them. The accounting of depletions should be in the format similar to that <br />shown on Table 1 B. The accounting form(s) shall be sufficient to demonstrate that the <br />net effective replacement equals or exceeds the total depletion on a monthly basis. All <br />replacement water must be concurrent with depletions in quantity, timing and location, <br />except that releases aggregated at the discretion of the Division Engineer or the <br />Augmentation Coordinator may occur in a later month than the depletions. <br />3. The accounting form submitted in the month of November each year (at the end of the <br />administrative Water Year) shall be submitted together with plan and cross-sectional <br />drawings of the pit on 8-1/2" x 11" paper showing; (1) the initial static water level, (2) the
