PERMIT #: M-1981-302 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: April 26, 2011 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Jeff Lipton, Jonathan Akins and Dave Lalibert of the University of Colorado were also present for the <br />inspection. The Deepe Farm Pit is located south of Table Mesa Dr. and west of Highway 36; the site is a part of <br />the University of Colorado campus. The site is permitted for 178.9 acres and the post-mining land use is <br />rangeland. <br />Hydrologic Balance: <br />As part of the approved Reclamation Plan, a perimeter levee was constructed around the south and east sides <br />of the site. The levee was designed to protect the area to the north from a one percent annual chance flood of <br />the South Boulder Creek. The design and final elevations of the levee were approved by the Division under <br />Technical Revision - 06 (TR06). As required by TR06, the Operator is required to inspect the levee annually and <br />submit a levee inspection report to the Division. The most recent levee inspection was conducted by the <br />Operator on April 7, 2011. The Division traversed the entire length of the levee during this inspection. The <br />access road on the top of the levee was in good condition. The vegetation on the pit-side slope was well <br />established and no signs of erosion or settling were observed. Several small trees and bushes growing from <br />the levee were observed; this has been noted in the most recent levee inspection report and the vegetation is <br />scheduled to be removed. <br />The Operator informed the Division that alterations to the levee have been carried out over the past several <br />years. The alterations include raising the elevation on portions of the levee as well as adding larger riprap <br />material to the stream-side slope of the levee. The changes to the Reclamation Plan were not submitted to the <br />Division for approval. This matter has been cited as a problem and will require corrective action by the <br />Operator; please see the first page of this report for additional details. The Operator shall submit a Technical <br />Revision including the following: <br />1. Provide the Division with an as-built survey of the crest elevations of the completed perimeter levee. <br />2. Provide the Division with a narrative describing all of the alterations to the perimeter levee and an <br />explanation of why the changes were required. <br />The Operator is in the process of obtaining Levee Certification for the perimeter levee; FEMA is currently <br />reviewing the Operator's application. <br />Reclamation Success: <br />The Reclamation Permit was transferred from Western Mobile Boulder, Inc. to the Regents of the University of <br />Colorado on November 28, 2000. According the 1998 Annual Report, mining was completed in 1997. <br />Construction Materials Rule 3.1.3 requires all reclamation to be complete within five (5) years from the time <br />mining ceases. This has been cited as a problem and will require corrective action by the Operator; please see <br />the first page of this report for additional details. <br />Based on the observations made during this inspection, the Division has determined the Operator must <br />address the following issues before this site can be released from further reclamation responsibility: <br />1.
