Following Larimer County's January 24 approval, Aggregate again <br />inquired as to the status of the Succession of Operator application and also provided to Trollco a copy of <br />the Division's February 1, 2011 Annual Fee Notice and Report Request, advising Trollco that they would <br />need to complete and submit the report and fee to the Division. By e-mail response dated February 8, <br />2011 (copy enclosed), Trollco's representative, Dick vonBernuth, advised that they would take care it. <br />As of this date, the Division's records indicate that the annual fee and report have not been submitted by <br />Trollco, nor have they submitted the Succession of Operator application. <br />It is clear that Aggregate Industries no longer has access to or any control of the mining and reclamation <br />activities at the Stegner Farms operation; however, Aggregate is submitting the enclosed fee in an <br />effort to avoid possible forfeiture of its financial warranty. We would request the Division's <br />consideration and direction in the matter of assuring that Trollco, as De facto operator under Stegner <br />Farms Permit M-1999-021, execute and submit the Succession of Operator together with the appropriate <br />replacement performance and financial warranties. <br />Very truly yours, <br /> <br />Connie N.
