OF ?yq <br />For Wildlife- <br />For People <br />RECEIVED <br />11'AY 16 2011 <br />¢-p Division of Reclamation, <br />Mining and Safety <br />RE: Febbraro Construction Co., The Broyles Pit, Permit No. M-2004-28 <br />Dear Mr. Ebert: <br />Recently the Colorado Division of Wildlife received a request for written comments concerning the, <br />conversion of the Broyles Pit from a 110(c) Limited Impact Construction Materials Permit to a 112(c) <br />Regular Construction Materials Permit. The original permit allowed for an affected area of 9.96 acres <br />and is proposing an amendment to expand that by 3 additional acres to 12.96 acres. If the application <br />was understood correctly, the gravel pile has already been located on these 3 acres. <br />This request was forwarded to District Wildlife Manager Jeremy Gallegos for wildlife assessment. <br />Wildlife species that may be commonly found either on the site or surrounding areas are elk, mule deer, <br />whitetail deer, pronghorn, scaled quail, western rattle snake, bull snake, garter snake, as well various <br />bird and raptor species. Although black tail prairie dogs are near the area, there are no known active <br />towns on the site. There are no known threatened or endangered species on the site as well. The <br />affected area can best be categorized as shallow soiled short grass prairie with several hills near the <br />riparian zone of the Purgatoire River. <br />Disturbance to the short grass prairie habitat is likely to occur due to the proposed action; however this <br />disturbance can be minimized if some recommendations are followed. <br />• ' i?A stockpile of topsoil- should beset. aside-for. reclamation purposes. -This'stockpile should also: be <br />temporarily seeded to minimize erosion losses, and then spread over the affected area prior to <br />seedirig:with native grasses, forbs, and shrubs. <br />• Vegetation establishment should be a key component of reclamation, not merely reseeding. <br />DEPARTMENT OF NATURAL RESOURCES, Mike King, Executive Director <br />WILDLIFE COMMISSION, Tim Glenn, Chair e Robert Streeter, Vice Chair • Mark Smith, Secretary <br />Members, David R.
