traffic was cut down to 30 trips a day, he considered that too much traffic for the
residents that live there. He noted that Lake Nighthorse didn't involve the hauling of
gravel in front of homes and said that this kind of impact on citizens concerned him, as
well as bicycle use and that the roads had not been constructed to the safety level of a
project of this magnitude. (Activated at 02:05:57)
Mr. Smith said that staff was recommending a revision to condition #19 as follows:
Noise levels associated with the facility shall not exceed the following:
A. During construction work and pit development: 80d (A) at 25 feet from the adjoining
property line. C.R.S. SS 25-12-103 (5)
B. During pit production; 55DB (A) at 25 feet from the adjoining property line. CRS SS
25-12-103, LPLUC 82-165,82-196.
He said this would comply with State Regulations.
Ms. Rogers suggested that PM-10 monitoring could be included. She said that she
would need time to work with the project to develop a written statement for an air
monitoring standard. Commissioner Hotter said that the Commissioners have
experience with PM-10 monitors and that can be very vague in application. Mr. Nau said
that monitors now include PM-10 and PM-2. She advised that such a request today
would require a continuance of the project. (Activated at 02:10:41)
Commissioner Lieb said he was concerned that the County was stepping into the realm
of other regulating bodies regarding monitoring air quality control. Ms. Rogers
suggested that the Tribe has a very good air quality program and the applicant has
already agreed to comply by it. (Activated at 02:19:02)
Mr. Aune noted that the language in Conditions #3 and #5 needed to be changed in
order to agree with one another. Mr. Smith provided the following language to be
struck. (Activated at 02:20:47)
3. Prior to commencement of construction and OssuaAGe of the Glar,6 11 ,
the applicant shall provide copies of such the following permits, as required by
the respective agencies, to the Planning Department (LPLUC 74-112 to 114, 82-
1(b), 82-196(3) 82-201(8)):
5. Prior to remmenremeAt Of GORStFUGtion and issuance of the Class II permit, the
noise berm to be located along CR 213 to the north of the access road shall be
constructed. (LPLUC 82-192)
Mr. Nau said the County Building department will work with the Tribe to enforce air
quality regulations, and though there isn't a clear enforcement understanding, the Tribe
would be the one to enforce regulations. Therefore, one mechanism to ensure
monitoring would be to use MP-10.
La Plata Board of county Commissioners Page 10 3/1/2011 Bo Add ?'- rti 81334
,ANIMAS (oCACI?(L ?oQA??L.
G kk &IrT M - P A.GG M -27
_ 4
I
