She noted that her land was located in a desert area that naturally emits dust and <br />that dust-devils occur whether there is a gravel pit operating or not. She said that she <br />felt that they can comply with the State and/or Tribal regulations. (Activated at <br />01:42:19) <br />Commissioner Hotter called for a 10 minutes break after which she reconvened the <br />meeting. She asked if there was any further public comment. (Activated at 01:48:32) <br />Mr. Delvin Gregg explained that while there is a Weeminuche employee who is <br />assigned the task of visually monitoring the air conditions during their daily operation, he <br />questioned whether that individual could be impartial. He suggested that an <br />independent source be used. (Activated at 01:49:09) <br />Deborah Caswell pointed out that there are different sources of odor emitted at a gravel <br />pit, especially if a concrete or asphalt plant is built. (Activated at 01:50:39) <br />Commissioner Hotter closed public comment and invited Mr. Hight to address the <br />Board. <br />Bradley Hight, Vice Chairman of the Ute Mountain Ute Tribe said the Tribe abides by all <br />Federal, State and County laws. He said that, as a Tribe, they are careful with natural <br />resources such as fish, land and water. He said that, regarding the working hours, they <br />are willing to comply with the Conditions set by the County and intend for this to be a <br />small operation. He said that, he too, must look out for the well-being of his people and <br />above all, assure that they are safe. (Activated at 01:51:25) <br />Commissioner Hotter said that she would like to respond to some of the concerns <br />regarding the noise and safety issues. She said that since this area is classified for <br />commercial /light industrial use that this kind of growth is to be expected in spite of there <br />being residential property as well. Regarding the possibility of electronic monitors she <br />asked staff to respond. She explained that the Commissioners could not add a <br />Condition of a second access. (Activated at 01:59:31) <br />Commissioner Lieb said that he, too, didn't feel the Commissioners could encumber the <br />existing project permit application with future plans for development and /or a secondary <br />access road. He said that he would like to see the construction company work with land <br />owners and neighbors to develop future plans. He noted that the gravel pit was an <br />industrial use and, as such, was located next to an industrial use, which he considered <br />to be a compatible use. He felt that the Conditions as put forth by staff were adequate. <br />(Activated at 02:03:15) <br />Commissioner White said that he agreed with Commissioners Lieb and Hotter and <br />thought it was a good location for a gravel pit. He said, though, that he wasn't sure that <br />it was compatible with the Airpark. He cited the County mission statement regarding the <br />protection of the health, safety and welfare of the citizens.
