Control Division and the US EPA's National Pollution Discharge Elimination <br />Program (NPDES) that CDPHE enforces. <br />WCA's current Certification to Discharge No. COR34-1372 is attached. A <br />request for re-issuance for the Stormwater Discharge Associated with <br />Sand and Gravel Mining and Processing for the Animas Glacier Gravel pit <br />including provisions for Concrete Batch Plant and Asphalt Hot Plant, <br />when applicable, will be submitted to CDPHE. <br />5. Colorado Division of Water Resources <br />Well permit No. 053789-F is active. Name change, as required, was <br />submitted on April 7, 2011. <br />Animas River is under-appropriated and is in a non critical water area. <br />Water Rights have been applied for through La Plata Combined Courts on <br />January 4, 2011. <br />6. US Army Corps of Engineers <br />No permit is required at the Animas River. There will be no discharge of <br />dredged or fill material. See attached email of December 20, 2010 from <br />USACE Durango Regulatory Field Office. <br />There will be no discharge of storm or waste water from site. <br />7. San Juan Basin Health Department <br />Wastewater System Permit has been applied for January 4, 2011. <br />8. The Colorado State Historical Preservation Office was contacted. Please see attached <br />letter dated April 11, 2011. <br />A portion of the site was cleared of archeological significance by the <br />Bureau of Reclamation during the Animas-La Plata project. See attached Bureau of <br />Reclamation letters dated July 12, 2010 and December 15, 2006. Mr.Tom Yoder of <br />SWCA Environmental Services stated that one site of concern 5LP2262 was not within <br />50' of the proposed access road. The site will be fenced off for protection. <br />Construction personnel have been and will continue to be trained on procedures of <br />discovering significant historic or cultural resources. The Animas Glacier Gravel pit is <br />on private land and Colorado State burial and archaeological protection legislation <br />applies and will be complied with. <br />9.
