EXHIBIT M - Other Permits and Licenses <br />AGG Pit Permit Requirements <br />1. La Plata County Board of County Commissioners Project #2010-0055 Animas Glacier <br />Gravel Pit Class II approval - Department Report and Decision Agenda are attached. <br />2. CDRMS Colorado Division of Reclamation, Mining and Safety <br />Requires compliance with State and Federal Laws <br />Legal Description, Index Map, Pre-Mining and Mining Plans of Affected <br />Lands, Reclamation Plan, Water Information, Wildlife Information, Soils <br />Information, , Vegetation Information, Climate Information, Reclamation <br />Costs, Other Permits and Licenses, Proof of Filings <br />3. Colorado Department of Public Health and Environment (CDPHE) Air Pollution <br />Division <br />Submit Air Pollution Emissions Notice (APEN) for "Mining Operations - <br />APEN and Application for Construction Permit and Fugitive Particulate <br />Emissions Control Plan" <br />Permit will include a Particulate Emissions Control Plan (PECP) that <br />restricts visible emissions on-site and Off-property transport of dust. It <br />contains control measures such as watering, re-vegetation, vehicle speed <br />and reclamation. <br />Process Equipment requires a separate APEN and Air Permit which <br />includes Opacity Test EPA Method 9. <br />A separate permit "Concrete Batching Plants - APEN and Application and <br />Construction Permit' 'is required. <br />A separate permit "Hot Mix Asphalt Plant - APEN and Application and <br />Construction Permit' 'is required and includes both stack tests for <br />particulate concentration and opacity tests. <br />Permits are valid for 5 years. <br />The Animas Glacier Gravel project is within the external boundaries of the Southern Ute <br />Indian Tribe (SUIT) Reservation. The SUIT is in the process of finalizing application to <br />administer the permit program with the US EPA for Air Quality and Stormwater Control. <br />Weeminuche Construction Authority will comply with the CDPHE including submitting <br />all appropriate applications while awaiting the final determination of the US EPA with <br />regards to the SUIT. When approved, WCA will comply with the SUIT program. <br />4.
