Neighbors and the Colorado Department of Transportation Aeronautical Division have identified <br />dust generated by the project as a concern. The applicant has proposed mitigation measures to <br />address potential disturbances from dust, including fitting equipment with high pressure water <br />sprayers, covering areas that cannot be sprayed with water with burlap or tarps, use of bag houses <br />on concrete and asphalt plants, spraying roads with magnesium chloride and water, spraying <br />exposed areas of the pit, using erosion control blankets to prevent blowing dust, shutting down <br />operations during excessive wind, re-vegetating exposed areas when possible, phasing work, <br />construction of natural earth barriers, enforcement of speed limits on haul roads, and graveling of <br />roads and storage yards. <br />In addition, noise has been of concern for neighbors as a result of operations and truck traffic both <br />on site and along La Posta Road. The applicant has provided a noise study verifying that the <br />project will meet all state statutes regarding noise. The applicant is constructing a berm adjacent to <br />the residential property at the southeast comer of the project property to mitigate for noise from <br />truck traffic along La Posta Road as it accesses the project site. <br />The applicant has proposed hours of operation to from 7AM to 5PM Monday through Friday, with <br />the option to have temporary increases in hours 15 days. a year, during which time they would like <br />to operate from 7AM to 7PM Monday through Saturday with prior notice to landowners who <br />request notification. <br />Adjacent landowners have also suggested that disturbances will be caused by vibrations generated <br />by the project. <br />Glare, radiation, and smoke have not been identified as significant concerns. <br />3) The development will not create adverse or unsightly views for neighbors and/ or the traveling <br />public. <br />Much of the activity proposed by this project will be located in such a manner that it will not be <br />seen by adjacent land uses due to the topographic features of the site. The processing equipment <br />will be located in a basin that is not visible from much of the adjacent areas. With the exception of <br />occasional activity at the higher elevations of the mining area, much of the excavation is proposed <br />to be located behind a berm located on the east side of the project area. The office area for the <br />project will be visible from portions of the Animas Airpark, however, the office is compatible with <br />the uses located within the airpark. <br />It is not anticipated the project will be significantly visible to the traveling public. The applicant's <br />agent has represented she drove along the roadways with potential views of the project site and <br />does not believe the activities will be significantly noticeable. <br />4) The development will not cause pollution of ground or surface water. <br />Storm water detention and drainage plans have been submitted and should address potential <br />pollution to surface water. Information provided in the submittal does not indicate pollution of <br />groundwater will occur as a result of the proposal. Magnesium Chloride is to be used for dust <br />mitigation; however, this is a commonly used substance. No agencies have commented that the <br />proposal will cause pollution to surface or ground water.
