Hence this Plan does not follow the exact layout of the SPCC regulation,
and accordingly a regulatory cross-reference is required (see Appendix 1).
The East RDD Project is determined to be subject to the Environmental Protection Agency
"SPCC" regulation 40 CFR Part 112, Oil Pollution Prevention and Response, based on the
following criteria:
• East RDD Project facilities will have an aggregate aboveground storage capacity in
excess of 1320 gallons for oil. Only containers of oil with a capacity of 55 gallons or
greater are counted to meet this threshold,
and
• East RDD Project facilities are located near navigable waters of the US which include
surface water, tributaries and dry gullies.
Based on the field activities at the East RDD Project, a research facility, which include:
• Drilling activities,
• Nahcolite leaching,
• Pyrolysis and Feasibility-Level Production,
• Reclamation,
the following sections of the SPCC regulation (table of the following page) are applicable:
Continued on next page
Printed: April 7, 2011 Section 2 Page 15 of 71
The controlled version of this "controlling document" resides online in Livelink®.
