With the pipeline having been taken underground, the breached <br />section of the strip of land that separated the ponds will not be backfilled but will remain as an open <br />channel between the ponds. The sides of this channel are being sloped at a minimum of 3:1. <br />The ditch repairs and upgrades proposed by the City and DCP's boring of its pipeline to take it below the <br />ground through the breached area between the two ponds are addressing the flood damages incurred at the <br />83`d Joint Venture site. As the damages and the repairs are non-mining related and are being conducted <br />by the City and DCP, we would request that the Division accept the above narratives as having addressed <br />the flood related items noted in the November 10 inspection report and remove the requirement to address <br />these items in the technical revision originally required under the March 31 inspection report. <br />We would finally note that Al was recently advised that the contract for the sale of the 83`d Joint Venture <br />property from Hills to the City was terminated. Aggregate is therefore now coordinating with Hills to <br />determine how they wish to proceed with the site. In an effort to assure that the required technical <br />revision adequately responds to items noted in the Division's March 31, 2010 inspection report and to <br />incorporate any other changes associated with Hill's retained ownership of the property, we are <br />requesting an extension of time to July 11, 2011 for filing of the technical revision. <br />Thank you for your consideration, and if you have any questions, please contact me at (970) 396-5252. <br />Very truly yours, <br />e ?? 4ra.,, <br />Connie N.
