A=?L <br />131.3 Sherman Street, Room 215 <br />Denver, CO 80203 ,/ INDUSTRIES <br />Re: Permit No. M-1992-069, 83`d Joint Venture - Corrective Action Update and Extension Request <br />Dear Mr. Ebert: <br />Your report of the Division's inspection conducted at the above-referenced site on March 31, 2010 <br />required that Aggregate Industries (AI) submit a technical revision to the permit to provide the Division <br />with a reclamation map that more accurately reflects the final reclaimed configuration of the site. Due to <br />an anticipated sale of the property from 83`d Joint Venture, LLC to City of Greeley and potential minor <br />changes to the reclaimed land form as a result of flooding of the site last June, the Division has approved <br />extensions of that deadline to allow an opportunity to incorporate any such changes into the final map. <br />Following your inspection of the flood damage to the site on November l 0, 2010, the deadline for <br />submittal of the technical revision was extended to May 11, 2011. By this letter we are providing an <br />update regarding the matters to be addressed in the technical revision; however, we are requesting another <br />extension for filing the revision as we continue to obtain information from City of Greeley (City) and <br />work with 83`d Joint Venture owners, Carl and Gary Hill (Hills), on those matters. <br />As noted in the Division's report of the November 10 inspection, the 83`d Joint Venture site was flooded <br />in June, 2010 when the Poudre River breached the headgate of the Boyd Freeman Ditch and subsequently <br />breached the slope on the west boundary of the site and the strip of un-mined land separating the west and <br />east ponds on the site. City of Greeley, as majority owner of the :Boyd Freeman Ditch, has been analyzing <br />alternatives for making repairs and improvements to the headgate and ditch channel and recently advised <br />Al of their plans to proceed with at least repairs and upgrades to the ditch channel after spring run-off this <br />year. The City reviewed its preliminary plans with Al and Hills on April 26, 2011. The plan proposes <br />piping some sections of the ditch, including the section where the ditch enters onto the 83`d Joint Venture <br />site on the west boundary and continuing along the west boundary of the site to the north. As part of the <br />ditch repair project, the City will also re-establish the pit slope on the west boundary where the ditch <br />breached into the site. <br />The gas line that runs through the strip of land that was breached between the two ponds is owned by <br />DCP, rather than City of Greeley as stated in the inspection report. At the time of the November <br />inspection, DCP was considering the possibility of constructing a support system for the exposed gas line, <br />however they recently decided to bore and take the line below ground through the breached area.
