4.) Please number the phases in the order they will be mined. <br />6.4.4 EXHIBIT D - Mining Plan <br />5.) Will the two track ranch road used to access the pit be substantially improved and upgraded <br />for the mining operation? If so, it appears this road is outside of the proposed permit boundary <br />and will need to be added to the 155.2 permit acreage. In order to increase the proposed <br />permit acreage, the Applicant must submit an amendment application; with any updated <br />exhibits, in accordance with Rule 1.8. If an amendment is submitted, it shall constitute a new <br />filing of the application and all deadlines will start anew and the decision date will be re-set. In <br />accordance with Rule 1.6.6, you will be required to publish and mail a new notice of the <br />application. <br />Or, the applicant could consider accessing the site on the northern end of the permit area and <br />creating an access road within the current proposed permit boundary. If this option is chosen, <br />the Exhibit C; Mining Plan Map will need to be updated depicting the new location of the <br />access/haul road. Also, the Exhibit E Reclamation Plan will need to address how the new access <br />road and haul road will be reclaimed. <br />6.) Revegetation success of mine sites is largely driven by an operator's ability to strip and <br />replace a representative topsoil material on a previously mined area. Topsoil material must not <br />-be screened as indicated in the submitted mine plan. Please commit to not processing the top <br />1-4 inches of topsoil. Also, please commit to stripping the top 1 to 4 inches of topsoil material <br />and stockpiling it for reclamation. <br />7.) Please indicate the species of wheatgrass and the amount of pounds per acre to be planted <br />on the topsoil stockpile? <br />8.) It appears the proposed pit excavation will be 4 to 15 feet deep on average. Please clarify <br />how the material will be excavated to these depths. Will the operator push the mined material <br />into piles leaving 3:1 slopes? Will any steep highwalls be created? If so, how long will they be, <br />at any given time during the operation? <br />9.) The Applicant is proposing a phased mining operation, with 15 acres of affected land at any <br />given time with 10 acres designated for mining and 5 acres for processing and stockpiling. <br />Please commit to completing all the steps required for reclamation in one mining phase prior to <br />continuing to the next mining phase. <br />10.) There appears to be a "water line" that runs through several of the mining phases. Please <br />describe this water line, and indicate how the mining and reclamation operation will be <br />conducted to protect this water line from damage. <br />11.) Given the material will be processed on site, please indicate how the surface and ground <br />water system will be protected from pollution (from fuel storage and sedimentation)? It is likely <br />a Stormwater Permit will be required from the Colorado Department of Public Health and <br />Environment. Please describe how any fuels will be stored on site, at a minimum they must be <br />placed in a lined berm that can contain 110% of the stored material. <br />Page 2 of 5
