PMeda <br />Greenwood Village, CO 80111 Director <br />RE: Third Adequacy'Letter for a 112d-1 Application, Amended CN701, <br />Wildcat Mining Corporation, May Day Idaho Mine Complex,"File No. M-1981-185. <br />Dear Mr. Robinson: <br />Herein, all references to the Act and Rules refer to the Colorado Mined Land Reclamation Act, <br />34-32-101 et seq., C.R.S. (the Act or Hard Rock Act), and to the Mineral Rules and Regulations of <br />the Colorado Mined Land Reclamation Board for Hard Rock, Metal and Designated Mining <br />Operations (the Rules). The current Act and Rules are available on the Division's web site at <br />www.mining.state.co.us. <br />On April 18, 2011, the Division of Reclamation, Mining and Safety (Division) received response <br />from Wildcat Mining Corporation (Applicant or Operator) to the adequacy issues identified by <br />the Division in correspondences dated March 29, 2011, and March 15, 2011. The Applicant's <br />response included a one acre addition of affected land not previously included within the <br />permit boundary. The Division determined the Applicant's response constituted an <br />amendment to the application for CN-01. Due to the amendment the decision date for CN-01 <br />has been extended to June 21, 2011. <br />Please be advised that CN-01 may be deemed inadequate and may be denied on June 21, 2011, <br />unless the adequacy review items, listed below and in the two attached review memoranda <br />from Peter Hays and David Bird can be addressed to the satisfaction of the Division. The <br />Division considers these issues to be preliminary for the amended application. Subsequent to <br />receipt and review of the Applicant's response to these items the Division may identify <br />additional items: <br />Preliminary Adequacy Issues for the Amended CN-01 <br />Public Notice <br />1.
