7. The plan states that approximately 2,000 cubic yards of host rock will be brought to the surface and used to
buttress the toe of the hill slope on the west side of the affected area. Please explain the reason(s) for
modifying an existing hill slope. What is the proposed angle of reclaimed slope gradient? Please also state
whether the host rock in its final configuration against the toe of the slope will partly or fully cover a
segment of the roadway along the hill.
8. Host rock s proposed to be brought out of the mine and permanently emplaced against a hill slope (as
mentioned in the paragraph above). The plan is to only use "clean" non-mineralized rock, to which this
office agrees is a necessary condition. Please describe the method(s) to be used to ensure that only non-
mineralized materials can be used.
9. There is an historic discharge from the existing portal, which is conveyed out of the mine through a buried
pipe to the pond. Please describe where the underground mine water originates. Does any of it originate in
an ore or mineralized zone? How will the underground prospecting activities, within existing workings and
with known groundwater, be carried out so as to not degrade water quality?
10. Advancing the underground workings through new tunnels or underground drilling may intercept
groundwater, in addition to the groundwater that presently discharges. Any additional groundwater will be
of as-yet unknown quality and quantity. Please understand that this office cannot approve a plan within a
prospecting notice if it is anticipated that groundwater resources could be intercepted or degraded.
11. The original NOI packet did not include a bond, which -is a deficiency, but no bond is required at this time.
The Division will calculate a bond amount during the review period and notify you as to the amount that is
required to be posted. Please be reminded that no prospecting activity may commence before the bond is
accepted by the Division.
These are the completeness and deficiency questions and issues that the Division has identified at this time. If further
questions arise, this office will notify you.
The NOI file number shown above has been assigned to this project; please ensure that it appears on all
correspondence. The Division must receive a response to all items listed above, within 60 days of the date of this
letter, or the NOI may be denied. Please ensure that you mail two complete sets of all response materials, which may
be sent directly to me at the Durango address below.
If you have questions you may reach me at the Division's Durango Field Office: 691 CR 233, Room A-2, Durango,
CO 81301; telephone: 970-247-5193.
Sincerely,
.P,(, 0"'k
Bob Oswald
Environmental Protection Specialist
Ec: Steve Shuey, DRMS Grand Junction
Cc: Lawrence J.
