Pineda <br />Director <br />Re: Lower Mountain Top Mine, Notice of Intent (NOI), File No. P-2011-009, Notice Incomplete and Deficient. <br />Dear Ms. King, <br />The Division has reviewed the above-named NOI materials and has identified several items that are either lacking or <br />appear to be deficient. These items are explained in the paragraphs below. Please respond to each item. <br />1. On the Public Form 2, the location information is incomplete: the boxes indicating township, range, and <br />principal meridian were not marked. Please provide replacement pages with this information correctly filled <br />in. (Note: The location information in Confidential Form lwas correctly and completely provided; no <br />replacement is needed for it.) <br />2. On Public Form 2, the signature page appears to have been borrowed from Form 1. Please provide a signed <br />and initialed signature page from the appropriate (Form 2) packet. <br />3. The area of the project is described in the narrative as 1.00 acre. The "working surface area" delineated on <br />the project maps (Figures 3 and 4) is estimated by this office to be nearly four acres. Please explain the <br />discrepancy, or revise the acreage figure or the maps, so that they correlate. (This is needed on maps for both <br />Form 1 and Form 2.) <br />4. The north arrows on the same maps (Figures 3 and 4) appear to point westerly instead of north. Please <br />provide revised maps with the proper corrections made. (This is needed on maps for both Forms 1 and 2.) <br />5. One further comment about the Figure 3 and Figure 4 maps: the existing concrete slab appears to rotate about <br />30 degrees from one figure to the next. It is assumed that this was an inadvertent mapping error, and that <br />changing the slab was not proposed. Please clarify this issue or revise this feature on the figures. <br />6. The proposed affected area lies on two patented claims (Zigzag M.S. and Blythe) as shown on Figures 3 and <br />4. However, the affected area extends beyond the claims, raising the question of land ownership and <br />prospector's right-of-entry onto or through those lands.
