Your response does not adequately
addressed the Divisions concerns. Please respond to the remaining adequacy issues described below.
1. Application Form Section 3.1. Please clarify the acreage to be added under Amendment AM-5. If
the acreage to be added is +2.0 acres, then you must submit Exhibit C Mining Plan Map depicting
the amended area. If the acreage to be added is as depicted on the "Amendment Application Site
Boundary" on Exhibit C Mining Plan, then you must submit a revised Application Form Section 3.1
showing the correct acreage.
• Jahn Engineering response comment: The total amended area acreage is approximately
2.70 acres. It has been shown on Exhibit C. The revised Application Form Section 3.1 Is
to be completed by others.
2. It is an
annual cereal grain that might provide cover for one growing season. If the Applicant is able to
develop the site by next spring, minor amounts of volunteer barley may come back, but with high
risk of annual and possibly perennial weeds. For that reason, the Division will require planting of
perennial grasses on this site. This can be accomplished in two ways: a) plant grasses when barley

19
