Division proposes to release $2,585,974.00. This release amount is $388,776 more than the amount <br />requested by CCC because CCC did not include the allowable indirect costs in their request amount. <br />The remaining bond liability, after the proposed release for SL-3 and as updated for current costs, <br />will be $80,570,965.00. Table 1 provides a summary of the SL-04 bond release amounts. Costs <br />proposed for release are associated with topsoil replacement and initial vegetation establishment. <br />Costs associated with the exclusion areas have been retained in the bond. No costs for backfilling <br />and grading, post-mining drainage channel construction, pond removal, topsoil replacement on <br />areas not included in the Phase II Bond Release, initial vegetation establishment on areas not <br />included in the Phase II Bond Release, reseeding or site maintenance were released. <br />The Division proposes grant Phase I Bond Release on 494.2 acres of the Colowyo Mine disturbed <br />area; 365.89 acres in the East Pit, 49.44 acres in the West Pit and 78.87 acres in the Section 16 Pit. <br />The Division also proposes to grant a Phase II Bond Release on 420.9 acres of the Colowyo Mine <br />disturbed area; 359.79 acres in the East Pit, 43.74 acres in the West Pit and 17.37 acres in the <br />Section 16 Pit. Table 2 shows the disturbed area acreage and all bond released acreages to date. <br />The proposed amount to be released for the partial Phase II Bond Release is less than the eighty-five <br />percent of the full required surety for the applicable area pursuant to Rule 3.03.1(2) (b). A summary <br />of the original liability amounts and all bond releases to date is presented in Table 3. The remaining <br />$80,570,965.00 is sufficient to complete all remaining reclamation work at the site if the work had <br />to be performed by the Division, including the cost of the remaining backfilling and grading, <br />drainage control reestablishment, topsoil redistribution, initial vegetation establishment and <br />reestablishing vegetation on any revegetated areas, should those areas fail. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br />Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the Craig Daily <br />Press as soon as possible. Requests for public hearing must be submitted to the Division in writing <br />within thirty days of the first publication in the Craig Daily Press.
