its operations. Applicant shall maintain such structure in good operating condition. <br />B. In the alternative the Applicant will, permit its water <br />entitlement to remain in the Fountain Mutual Ditch and flow into the Little <br />Johnson Reservoir to recharge and replace depletion to the aquifer and Fountain ? <br />River caused by its out of priority pumping. If Little Johnson Reservoir is used for <br />recharge, depletion credits will be reduced by 16%. The 16% figure used to reduce YA <br />depletion credits will be subject to adjustment if future engineering studies develop <br />a different percentage factor for other users of the Little Johnson Reservoir site <br />for recharge. The average percentage reduction factor applied to all other users In <br />each year shall then be substituted for the 16% factor. <br />4. That the calculations for depletions caused by the pumping of the <br />Applicant's wells is directly related to the production of its plant for the washing of <br />gravel and concrete manufacturing purposes. That the Applicant will report <br />V -monthly the production of gravel in tons and the monthly production of concrete <br />from its Ready Mix operation in cubic yards by application of the Formula provided <br />herein will replace the depletions calculated pursuant to said Formula. The <br />Applicant will furnish these reports to the Water Commissioner of Water District <br />C5 <br />No. 10 and to Wheeeler and Associates on a monthly basis on or before the 10th day 1 <br />of the following month. The replacement water to be provided in each month shall <br />11 <br />be that amount required under the Formula to cover depletions as a result of I c ?; <br />production shown for the preceeding month. The depletion credit allowance for <br />?l V <br />Fountain Mutual Water shall be the percentage indicated in the formula as ?\s ' y <br />hereinafter provided. <br />5. The Formula to be used to calculate monthly Transit Mix <br />depletions and credit percentages for Fountain Mutual Water owned by the <br />Applicant and represented by 104 shares of Fountian Mutual Stock are as follows, <br />to-wit: <br />Monthly Depletion (D) = .052 P + 0.21 A + 0.092R <br />Where P = previous month's production in thousands of tons <br />Where R = previous month's Ready Mix production in thousands of <br />cubic yards <br />A = Any ponds used Iii cr resl'Ung from, t';^ Transit Mix Operation <br />in acres <br />(1.66 unless otherwise determined) <br />-3- <br />
