Exhibit C (c) - Topography: Exhibit C (c) has been revised to show the appropriate scale and slopes <br />within the pit. Please disregard the second Exhibit C (c) showing a close up of the topography. The <br />revised exhibit is attached. <br />4. Exhibit C (d) - has been changed to show a scale of 1:7,920, measurements are based on aerial <br />photography and therefore approximated. The revised exhibit is attached. <br />5. Exhibit C (d) - There are no sufficient landmarks in this rural area. Measurements begin 30' (thirty) <br />feet east of the Northwest corner of Section 10 along the North line of Section 10. The revised exhibit <br />is attached. <br />6. Exhibit C (e) has been revised to a scale of 1:7,920 and to show the present vegetation and soil types. <br />The exhibit has been reduced to the affected area. The revised exhibit is attached. <br />7. Exhibit C (g) - The unnamed dry creek bed running through the Kues pit was temporarily affected by <br />mining. The area has been re-graded to the original contours of the land. There is no ponding <br />occurring on site at this time. This creek bed is normally dry and may only run in the event of a heavy <br />rain. Logan County has received a Certification to Discharge, Certification Number COR341591, from <br />the Department of Public Health and Environment, Water Quality Division. The second dry creek bed <br />that you refer to is outside of the current pit area and the requested expansion area. Mining <br />operations and final grading are not expected to affect this drainage area. A copy of the Certification <br />to Discharge is attached. Any drainage gradient that is disturbed will be re-established to allow storm <br />water to leave the site post mining. <br />8. Exhibit C (g) has been revised to a scale of 1:7,920. The revised exhibit is attached. <br />9. Exhibit C (h) has been revised to a scale of 1:7,920 and confined to the affected area. The revised <br />exhibit is attached. <br />10. Exhibit C (i) has been revised to a scale of 1:7,920. The revised exhibit is attached. <br />11. The drainage gradient will be re-established to allow storm water to leave the site post mining. <br />EXHIBIT D <br />1. Exhibit D has been revised to include a setback for the West boundary of the expansion area near an <br />existing fence, power line and CR 67. <br />2. Exhibit D Mining Plan has been changed to clarify the fourth and fifth sentences. "Ponding of water <br />may occur after a significant rain but will not remain long, due to the absorption rate of the soil.," as been <br />revised to read: "Temporary ponding of water may occur after a significant rain but will not remain long, <br />2
