Aril 25, 2011 <br />The following inspection tonics were identified as having Problems or Possible Violations OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action <br />INSPECTION TOPIC: Hydrologic Balance <br />PROBLEM/POSSIBLE VIOLATION: Problem: The dewatering activities at the Durham Pit have negatively <br />impacted the irrigation well located on Mr. Huff's property. <br />CORRECTIVE ACTIONS: Provide the Division with a copy of the written agreement between Mr. Huff and Varra <br />Companies, Inc. to supply Mr. Huff with adequate irrigation water and a copy of hydrologic investigation report <br />written CGRS. <br />CORRECTIVE ACTION DUE DATE: 5/16/11 <br />OBSERVATIONS <br />The Durham Sand & Gravel Pit, File No. M-1978-056, was inspected by Peter Hays and Michael Cunningham <br />with the Division of Reclamation, Mining and Safety (Division) as a result of a citizen complaint filed against <br />the operation. Mr. Brad Janes with Varra Companies, Inc. was present during the inspection. <br />The Division received a complaint letter from Mr. James Gustafson representing Mr. Rich Huff on March 29, <br />2011. The letter stated Mr. Huff was having a problem pumping water from the McNamara Well #2, Well No. <br />23048F, located in the SW % of the NW %, Section 10, Township 5 N, Range 65 W of the 6th P.M., Weld County <br />Colorado. The well was decreed as an exempt well on February 17, 2006 and at that time the water level was <br />approximately 14 feet below ground level according to Mr. Huff. In 2004-2005, Varra Companies, Inc. was <br />required to ask Mr. Huff for permission to install a well for their concrete operations, because his exempt well <br />is within 600 feet of the new well. Mr. Huff was able to pump water from the well twice during 2009 and was <br />unable to pump any water during 2010. <br />Page 1 of 4 <br />? Cccti
