STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832-8106
MEMORANDUM
TO: JANET BINNS
FROM: ROB ZUBER, KENT GORHAM
SUBJECT: COLOWYO PR-03, FIRST ADEQUACY RESPONSE
DATE: APRIL 21, 2011
COLORADO
D I V IS I ON OF
RECLAMATION
MINING
SAFETY
Please find below our response to the adequacy review responses received from Colowyo
Coal Company (CCC) dated March 25, 2011 for Permit Revision No. 3 (PR-03). Included
are questions resulting from a detailed review of Exhibit 7, Item 23, consisting of SEDCAD
model inputs and results. Our response is organized using the Rule heading format and
question number of our original adequacy letter. Additional questions were added
sequentially by number designations (and by letter in Rule 4.05.6).
Rule 2.04.7 Hydrology Description
The data is available on the USGS site. The number for the site is "09250700" rather
than "9250700" as originally stated in the Division's letter. Also, this site can be
accessed by name, "Morgan Gulch near Axial, Colorado," rather than number. Please
check this data again and correct as necessary.
2. The response was adequate. Colowyo has updated the text on page 47 of Rule 2.
3. CCC has provided locations on Map 11 C as requested. Please indicate where in the
permit text narrative the Division can find the references to Colowyo's ownership of
wells within the permit boundary, in particular, those owned by others as identified in
Table 2.04.7-44. Specifically, wells permitted to Dudek and Sweeney are of concern.
These wells are in relatively close proximity to the Collom pit. If the permit text
narrative does not exist, please add it to the appropriate section. Permit text narrative
on page 133 states "Some of these wells may be registered to Utah International or
other names but these are all under the control of Colowyo." Please provide evidence
that demonstrates Colowyo owns or controls wells owned by others and specifically
identify that ownership in Table 2.04.7-44.
Rule 2.04.7(3) Alternative Water Supply Information
The application remains inadequate. Revised information submitted on page 133
under the heading "Potential Impacts to Groundwater Users due to Pit Dewatering and
Development" provides no specific information on wells, well ownership, well permit
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
