Mr. Barnard <br />Page 1 2 <br />April 18, 2011 <br />6.3.3 Exhibit C - Mining Plan <br />2. As required by Rule 6.3.3(b), specify how topsoil will be stabilized. The Division <br />recommends using a vegetative cover to stabilize the topsoil stockpile. If the Operator <br />chooses to use a vegetative cover, then the grass species to be planted and the quantities must <br />be specified. <br />3. The Applicant has stated rock that is not of acceptable quality will be returned to the quarry <br />as fill. As required by Rule 6.3.3(c), specify the quantity of waste rock which will be <br />stockpiled during the life of the mine; the quantity of waste rock should be reported as cubic <br />yards. The Division requires this information in order to calculate the amount of the financial <br />warranty. <br />4. As required by Rule 6.3.3(f), specify the dimensions of any significant disturbances to the <br />land surface including both of the active quarry areas, the waste rock stockpile, and the <br />topsoil stockpile. <br />5. The Applicant has state roads within the quarry will be constantly changing. As required by <br />Rule 6.3.3(g), please specify any existing or proposed roads that will be used for the mining <br />operation. The Division requires this information in order to calculate the amount of the <br />financial warranty. <br />6. During the previous inspection of the Barnard Quarry, the Division observed that stormwater <br />runoff is intercepted by the active quarry area. As required by Rule 6.3.3(i), describe how <br />mining will affect the quantity and quality of the surface water and the methods to be used to <br />minimize disturbance to the surface water systems including proposed dewatering and <br />stormwater runoff controls. <br />7. As required by Rule 6.3.30), specify how you will comply with applicable Colorado water <br />laws and regulations governing injury to existing water rights. The Operator should keep in <br />mind that if stormwater runoff is intercepted and not diverted or captured in priority, it must <br />be released to the stream system within 72 hours. The Operator should specify how they will <br />handle stormwater runoff, e.g., by diverting stormwater around the quarry area or pumping <br />stormwater from the quarry pit within 72 hours after it is captured. <br />6.3.4 Exhibit D - Reclamation Plan <br />The Applicant has stated retaining walls and terraces may be constructed as part of the <br />Reclamation Plan. If the Applicant chooses to construct retaining walls and terraces, then the <br />dimensions of the structures must be specified and the location of the structures must be <br />illustrated on the Reclamation Plan Map. Please clarify if the structures will be constructed or <br />if the entire site will be graded to 3H:1 V or flatter through backfilling the quarry pits. The <br />Applicant may revise the Reclamation Plan at a later date through the filing of a Technical <br />Revision.
