CM0001501 <br />STAFF REPORT: Climax Mine File No. 1041-0072 <br />BoCC Hearing Date: June 24, 2008 <br />(6) <br />(7) <br />The Project is technically and financially feasible. <br />[+] FINDING: (5) Feasibility, The Project IS technically and financially feasible. j <br />The Project is not subject to significant risk from natural hazards. <br />It is improbable that the Project will be affected by, or subject to significant risk from, natural hazards, <br />such as earthquakes, avalanches or snow slides, rock slides, floods, or wildfires. The existing Robinson <br />Lake Pump Station building has been unaffected by natural hazards since its construction in 1936 and the <br />wildfire hazard rating for the Project area is identified as very low on Eagle County's Wildfire Hazard <br />Rating Map. <br />[+] FINDING: (6) Risk from hazards. The project IS NOT subject to significant risk from natural <br />hazards. <br />The Project will not have a significant adverse effect on land use patterns. <br />The existing and replacement pump stations are located within the active operations area of the mine <br />site, entirely within the Climax Mine property boundaries. This area is zoned Resource, which allows <br />mining. This Project does not involve a change in proposed land use, and therefore is considered <br />consistent with the planned use for the area. Future, post-mining, land use for the area is addressed in <br />the Mine Reclamation Permit issued by the DRMS, which for the Project area would be rangeland as <br />defined by the Mined Land Reclamation Board. <br />The replacement of the pump station will have no effect on land use patterns of the area. <br />[+] FINDING: (7) Land use patterns. Land use patterns in the WILL NOT have a significant adverse <br />effect on land use patterns as a result of this 1041 Permit application. <br />(8) The Project will not have a significant adverse effect on the capability of local <br />governments affected by the Project to provide services, or exceed the capacity of <br />service delivery systems. <br />The replacement of the pump station will not have any effect on the capability of local government within <br />the County to provide services or exceed the capacity of local government service delivery systems within <br />the County. <br />Staff Report Date: 06.24.08 Eagle County Community Development <br />Page 4 of 11 <br /> <br />C, <br />•
