They wanted to ensure that `safeguards' were in place for water quality of the Eagle Park Resevoir. • <br />2. FINDINGS & RECOMMENDATIONS <br />A. Pursuant to Eagle County Land Use Regulations, Section 6.04.01, Permit Application Approval <br />Criteria for Matters of State Interest, and as more specifically described in the application materials, <br />the following analysis is provided. The Approval Criteria is numbered and indicated in bold. A <br />summary response is provided with the recommendation indicated in the findings box. <br />(1) Documentation that prior to site disturbance for the Project, the applicant will have <br />obtained all necessary property rights, permits and approvals. The Board may, at its <br />discretion, defer making a final decision on the application until outstanding property <br />rights, permits and approvals are obtained. <br />The Project will be conducted entirely on land owned and controlled by the Climax Molybdenum <br />Company. The Climax Mine is regulated under active permits issued by the Colorado Division of <br />Reclamation, Mining and Safety (DRMS), the Colorado Air Pollution Control Division, and the Colorado <br />Water Quality Control Division. The latter two divisions are within the Colorado Department of Public <br />Health and Environment (CDPHE).
