Box 1598 • Fairplay, CO 80440 • Phone: 719.836.4271 • Fax: 719.836.4351 <br />Yori Kostick/Bob Narracci <br />Eagle County Community Development <br />Po Box 179 <br />Eagle, Co 81631 <br />Gentlemen, <br />Thank you for asking me to review and make comments to this 1041 application. <br />After reviewing the documents submitted by Climax Molybdenum Company, as part of the 1041 Permit <br />application submittal for the proposed Robinson Lake Pump Station Replacement, I submit the following <br />comments and observations. <br />Attachment B <br />(1) Applicant should demonstrate that all permits for this mining operation are active and in compliance <br />with any associated conditions. Such as Permit#M-77-493, COR-040178, Permit # CO-0000248 and <br />Permit# 04LK0877. <br />(4) Relative to the statement from the applicant's report 4. Technical and Financial Feasibiiity of the <br />Proiect,"capital costs $777,000,no revenue, annual operation costs $767,500 /year..." <br />• How where these numbers derived? How will the operations costs be addressed within the company's <br />budget for long-term operations? <br />(13) "Water trucks will provide dust control during construction." Where is the water coming from? Is it a <br />permitted source? <br />(15) Since the Robinson Lake Pump Station (replacement) is part of the process water reclaim system, <br />this would directly relate to this project, demonstrating no significantly degraded surface water quality. <br />Therefore, relating back to the requirement (1) that the applicant should demonstrate that all permits are <br />active and have been in compliance. In order to demonstrate that no significant surface water quality <br />degradation has occurred. <br />(16) The same said relationship is true for groundwater quality. <br />Even though surface and ground water is regulated by state permits, the applicant has not demonstrated <br />that pursuant to this 1041 permit application that they have been in compliance with surface and ground <br />water quality. <br />(18 & 19) The same said relationship is true for these two sections. Specifically, any impacts to aquatic <br />animals and plant life. What is the impact to both aquatic animals and plants at the discharge point <br />entering Tenmile Creek? How does the state rate this section of stream? Under a permit Climax can <br />discharge but has Climax met or exceed discharge limits? <br />(22) Has there been an archaeological assessment done on this proposed project? Maybe this can be <br />addressed by mitigation through agreement between Eagle County Historical Society and the applicant. <br />ECHS will be notified by the application if any artifacts are unearthed during construction, so that they can <br />be evaluated and documented. <br />0 <br />
