CM0001307 <br />Findings of Fact, Conclusions of Law, Judgment and Decree <br />Case Nos. 92CW233 and 92CW336 - Page 33 <br />3.2.33 West Interceptor, South. The West Interceptor, South runs southwesterly <br />along the northwest side of Robinson Tailing Pond and discharges water into the Eagle River <br />drainage basin. The facility is located in the Southwest/4 of the Southwest'/4 of Section 27, <br />Township 7 South, Range 79 West, 6`h P.M. The West Interceptor, South diverts surface flow, <br />seepage, and run-off from watersheds that are tributary to Tenmile Creek at a maximum rate of <br />7.0 cfs. <br />3.2.34 Hi way Interceptor. The Highway Interceptor runs in a northerly <br />direction and discharges into the East Tailing Delivery Pipeline. The facility is located in the <br />Northwest/4 of Section 2, Township 8 South, Range 79 West, 6' P.M. The Highway Interceptor <br />diverts surface flow, seepage, and run-off from watersheds that are tributary to Tenmile Creek at <br />a maximum rate of flow of 10.0 cfs. <br />3.3 Changes in Places of Stora e. <br />g <br />3.3.1 Storage of Direct Flow Water. Applicant requests that the historic <br />consumptive use component of its direct flow water rights may be stored, prior to or after use, <br />with the right of carry-over storage from year-to-year (consumptive use portion only), in the <br />System's storage components of Robinson Reservoir, Chalk Mountain Reservoir, Buffehr's <br />Lake, the Climax Mine Underground Levels, Mayflower Pond, and Tenmile Pond, and Robinson <br />Pond. See, Section 3.2 above for descriptions of these facilities. <br />3.3.2 Alternate Places of Storage. Applicant proposes to continue storing water <br />under its storage rights in the already decreed places of storage for those rights, as well as in the <br />System's above-referenced storage components as alternate places of storage; provided, however, <br />• <br />56642.WPD:5
