CM0001293 <br />Findings of Fact, Conclusions of Law, Judgment and Decree <br />Case Nos. 92CW233 and 92CW336 -Page 19 <br />(2) Amount: 642 acre feet <br />(3) Appropriation date: January 9, 1943 <br />(4) Historic use: mining, milling, manufacturing, and <br />domestic purposes at the Climax Mine, depicted in Exhibit 1. <br />2.4.6 Chalk Mountain Reservoir. Chalk Mountain Reservoir is a 205 acre feet <br />reservoir located in the drainage of the East Fork of the Eagle River in the Southwest corner of <br />Section 34, Township 7 South, Range 79 West, 6 h P.M. The Chalk Mountain Reservoir storage <br />right was decreed as follows on October 23, 1953 by the Eagle County District Court in Civil <br />Action 1193: <br />a. Sources: Tenmile Creek and tributaries thereof, as decreed by the <br />Summit County District Court in Civil Action 1710; also, that part of the drainage basin of the <br />East Fork of the Eagle River lying above and tributary to Chalk Mountain Reservoir, being an <br />area of approximately .32 square miles, including both surface run-off and underground flow. <br />b. Amount: 204.1 acre feet <br />c. Appropriation date: July 24, 195.1 <br />d. Historic Use: mining, milling, manufacturing, and domestic <br />purposes at the Climax Mine, depicted in Exhibit No. 1. <br />2.4.7 The Clear Water Pond Pump. The decreed point of diversion for the Clear <br />Water Pond Pump is on the left bank of Tenmile Creek from whence the Northwest corner of <br />Section 2, Township 8 South, Range 79 West, 6t' P.M., bears South 6°38' East 6140 feet.
