CM0001332
Findings of Fact, Conclusions of Law, Judgment and Decree
Case Nos. 92CW233 and 92CW336 - Page 58
D = 0.021V
If neither the Tenmile Creek basin nor the Eagle River basin
segments of the Chalk Mountain Interceptor are being operated to
bypass water around Robinson Reservoir, then
D = 0.035V
WHERE:
D is Eagle River basin depletions; and
V is the virgin flow at the Climax Mine Property Line
Flume on Tenmile Creek. Virgin flow equals
measured flows at the Climax Mine Property Line
Flume, plus depletions to Tenmile Creek under
Applicant's Tenmile Creek water rights, minus
deliveries of water into Tenmile Creek from the
Arkansas and Eagle River basins.
d. Operations of Robinson Reservoir, Chalk Mountain Reservoir, and
0 the Chalk Mountain Reservoir Interceptor Ditch are expected to change in the future as a result of
projected modifications to the milling system and reclamation, which may reduce deliveries of
process water from the Tenmile Creek basin to the Eagle River basin. Such modifications may
render obsolete the methods provided above in subparagraphs 6.2.2.a. through c. to determine
Eagle River inflows and depletions. Therefore, if and when the modifications occur, total
depletions to the East Fork of the Eagle River shall be determined on a monthly basis, through
use of an accounting system acceptable to the Division Engineer that is no less restrictive than
the methods provided in subparagraphs 6.2.2.a. through c. The accounting system shall take into
account natural inflows, transbasin diversions from the Tenmile and Arkansas River basins,
changes in storage in Robinson Reservoir and Chalk Mountain Reservoir, releases, and operation
of the Chalk Mountain Interceptor Ditch.
•
56642.
