CM0001331
Findings of Fact, Conclusions of Law, Judgment and Decree
Case Nos. 92CW233 and 92CW336 - Page 57
Accordingly, the Tenmile Creek water diverted by the Chalk Mountain Interceptor Ditch shall be
tributary to the East Fork of the Eagle River and be available for use therein. Seepage and
underdrain water entering Robinson Reservoir from the Robinson Tailing Pond shall be
accounted for in a similar manner.
b. Notwithstanding the preceding subparagraph 6.2.2.a., there will be
a net depletion to the Eagle River basin if either of the following conditions occur: i) the Chalk
Interceptor Mountain Ditch is not operated, or ii) water is delivered from the Chalk Mountain
Interceptor Ditch into Robinson or Chalk Mountain Reservoirs. However, so long as all water
entering Robinson and Chalk Mountain Reservoirs is retained in those facilities and subsequently
pumped to the Tenmile Creek basin, the occurrence of conditions i) or ii) shall not result in a net
depletion to the Tenmile Creek basin.
C. Taking into account the provisions of the preceding subparagraphs
6.2.2.a. and b., so long as the complex system of operations described in this paragraph 6.2
continues, depletions to the Eagle River basin shall be calculated as follows:
If both the Tenmile Creek basin and Eagle River basin segments of
the Chalk Mountain Interceptor are being operated to bypass water
around Robinson Reservoir, then
D=0
If only the Tenmile Creek basin segment of the Chalk Mountain
Interceptor is being operated to bypass water around Robinson
Reservoir, then
D = 0.014V
If only the Eagle River basin segment of the Chalk Mountain
Interceptor is being operated to bypass water around Robinson
Reservoir, then 0
56642.
