As described herein, there are <br />water facilities located in or near Applicant's property in the East Fork Eagle River basin that are <br />operationally connected to Tenmile Creek. Under historic and present operations, large volumes <br />of process water have been continually decanted from Tenmile and Robinson tailing ponds, <br />delivered to the Eagle River basin for storage in Robinson Reservoir, and subsequently returned <br />to the Mill and reused, or treated and discharged into Tenmile Creek at the Climax Mine Property <br />Line Flume. In addition, Robinson and Chalk Mountain Reservoirs impound inflows tributary to <br />the Eagle River basin, which water is also pumped back to the Mill for beneficial use. Because <br />the Applicant has neither the permits nor the facilities to enable the treatment and discharge of <br />process water into the Eagle River basin, Applicants operations require that all water impounded <br />in Robinson and Chalk Mountain Reservoirs must be either consumed by the Applicant under its <br />water rights or eventually discharged into Tenmile Creek after treatment. Furthermore, the Chalk <br />Mountain Interceptor Ditch collects water from the headwaters. of Tenmile Creek and the East <br />Fork of the Eagle River, and either i) delivers the water directly to the Eagle River, ii) delivers <br />the water to Robinson or Chalk Mountain Reservoirs, or iii) will deliver the water to Eagle Park <br />Reservoir, a facility which is owned by the Eagle Park Reservoir Company. Because the purpose <br />of the Chalk Mountain Interceptor Ditch is to bypass uncontaminated water around the Climax <br />Mine industrial process water system, deliveries of Tenmile Creek water by the ditch into the <br />Eagle River basin cannot be operationally prevented. <br />is <br />56642.
