CM0001328
Findings of Fact, Conclusions of Law, Judgment and Decree
Case Nos. 92CW233 and 92CW336 - Page 54
d. Water trapped in waste rock. The following calculation shall be
used to determine the volume of water trapped in the waste rock quarried from the mine:
Waste Rock Trapped Water (in acre feet) = Tons of waste rock quarried x 6.0
gallons
325,850
e. Water consumed from miscellaneous activities at the Climax
Mine. Miscellaneous water consumption includes water consumed in product moisture and
steam loss, water consumed in mill dust collectors, water used in concrete production, domestic
water use, and evaporation from various process facilities and holding tanks. Because such uses
do not occur during times when the Climax Mine is not in production, depletions shall not be
attributed to such uses during periods the mine is not operating. During periods when the Climax
Mine is in operation, the following calculation shall be used to determine the amount of such
depletions.
Miscellaneous Water Losses = 2.3 AF per month + Tons of ore processed x
(in acre feet) 2.3 gallons
325,850
f. Changes in the volume of Tenmile Creek basin tailing ponds
and reservoirs. Changes in the volume of water on the tailing ponds and reservoirs shall be
calculated on a monthly basis, taking into account the change in water surface elevation, tailing
deposition, and other relevant factors. For those tailing ponds into which tailing is being
deposited, an annual physical measurement shall be made of the water pool volume.
g. Storage or delivery of water leased or sold to other water users.
The amount of water leased or sold by the Applicant to other water users shall be calculated
based upon the monthly amount of water stored in Applicant's storage facilities, or delivered
56642.WPD:5
