5) Location of Water Depletions: <br />a) Recharge accretions and stream depletions do not affect the river at a single <br />point; rather, such accretions and depletions affect a reach of the river, the <br />midpoint of which represents the point in the river upstream of which 50% of <br />the accretions/depletions affect the river and downstream of which 50% of <br />the accretions/depletions affect the river. The reach and amount of <br />accretions/depletions are a function of the distance of the well from the river <br />and time. The midpoint of accretions/depletions can be determined by <br />calculating the shortest distance to the stream from the water structure by <br />perpendicular line to the stream. <br />b) Based on the shortest distance from the approximate centroid for the Pinneo <br />Feedlot Wells to the South Platte River, the midpoint of depletions from the <br />Pinneo Feedlot Wells and the Uhlenhopp Well reaches the South Platte River <br />at a location in the SW 1/4 NW 1/4 of Section 8, Township 4 North, Range 55 <br />West, 6t' P.M., Morgan County, Colorado. Based on the location of the <br />midpoint of depletions from the Pinneo Feedlot Wells and the Uhlenhopp <br />Well, 70% of the depletions from said wells affect the South Platte River <br />upstream of the inlet to the North Sterling Canal and 30% of the depletions <br />affect the river downstream of the inlet to the North Sterling Canal. <br />6) Pre-Decree Pumping and Evaporative Losses: A table showing calculated <br />monthly pumping and evaporative losses from each structure to be augmented <br />under this plan for augmentation for the period March 15, 1974 through June 30, <br />2010, prior to lagging of depletions, is attached as Exhibit B. <br />B. Water rijzhts to be used for augmentation: <br />1) Recharge credits available under the Farmers State Bank of Brush Recharge and <br />Augmentation Project, a.k.a. Headley Recharge and Augmentation Project <br />("Headley Recharge Project"). <br />a) Prior adjudications: The Headley Recharge Project was decreed in Case No. <br />90CW 189, Water Division No. 1, entered November 23, 1992. The Court <br />decreed certain conditional water rights absolute and/or entered findings of <br />reasonable diligence on other conditional water rights associated with the <br />Headley Recharge Project in Case No. 98CW416, Water Division No. 1, on <br />January 31, 2001 and in Case No. 07CW21, Water Division No. 1, on <br />November 4, 2009. <br />b) Legal descriptions: <br />(1) Point of diversion: The Riverside Canal Headgate located on the <br />North bank of the South Platte River in the SW1/4 SW1/4 of Section <br />9of33
