(which, per the well permit, had been located in one of the gravel pits on the <br />property) had previously been disconnected and the pump had been pulled. <br />Headley Wells 3993-F and 5709-F were last used in October 2003, and <br />power to each well was disconnected in April 2004. Each well had been <br />equipped with a flow meter in 1993. Prior to that time the only available <br />estimates of well pumping were estimates included as part of annually <br />approved substitute water supply plans submitted by Groundwater <br />Appropriators of the South Platte, Inc. ("GASP"). GASP showed no records <br />of pumping of Headley Wells 5709-F and 10794-F prior to 1993. <br />c) Gravel mining operations on the Headley Farm, which had been <br />discontinued by the time Pinneo acquired the property, left Gravel Pits Nos. <br />1 and 2 as a single pond. No exposed ground water remains in Gravel Pit <br />No. 4a. A small amount of exposed ground water remains in Gravel Pit Nos. <br />1 and 2. <br />d) In substitute water supply plans approved annually since 2004 by the State <br />Engineer pursuant to C.R.S. § 37-92-308(4), for the replacement of out-of- <br />priority depletions associated with use of the Pinneo Wells, Pinneo has <br />continued to account for augmentation obligations created by virtue of any <br />past and continued uses on the Headley Farm and all the resulting out-of- <br />priority depletions therefrom to the South Platte River. The recharge credits <br />available from Pinneo's interest in the Headley :Recharge Project for <br />augmentation of the Pinneo Feedlot Wells are therefore limited to those <br />credits that exceed such prior augmentation obligations. The midpoint of <br />accretions from the Headley Recharge Project reaches the South Platte River <br />at a location in the NW 1/4 SW 1/4 of Section 33, Township 5 North, Range <br />55 West, 6a' P.M., Morgan County, Colorado. Based on the midpoint of <br />accretions, 49% of the accretions affect the South Platte River upstream of <br />the inlet to the North Sterling Canal and 51% of the accretions affect the <br />river downstream of the inlet to the North Sterling Canal. <br />2) Jackson Lake Rights: <br />a) Pinneo purchased the Jackson Lake Rights along with a farm under the <br />Lower Platte and Beaver Canal in 1991. The Jackson Lake Rights were <br />historically used on the Lower Platte and Beaver Canal farm until the farm <br />was sold in 2003. <br />b) The water rights represented by shares in Jackson Lake Reservoir and <br />Irrigation Company are a senior and sought-after supplemental irrigation <br />supply that serves multiple ditch systems in the area. <br />c) Because not all of the water released under the Jackson Lake Rights was <br />historically consumed during irrigation, Pinneo's future use of such water for <br />augmentation and replacement purposes must account for historical return <br />13 of 33
