wildlife habitat, recreation, and aesthetic purposes; or used for recharge of <br />the alluvial aquifer and augmentation purposes.2 Pinneo has acquired the <br />land containing the recharge ponds and the 50 percent share of the water <br />recharge credits available under the Headley Recharge Project, both of which <br />were owned by Farmers State Bank of Brush at the time of entry of the <br />Headley Recharge Project decree. <br />2) Jackson Lake Rights as described in more detail in Paragraph 8(A) above. <br />3) Booth Farm Well Right as described in more detail in Paragraph 8(B) above, <br />provided, however, that prior to any use of the Booth Farm Well Right for <br />augmentation and replacement, either directly or by recharge, the requirements of <br />Paragraph 28(C)(1) must be satisfied. <br />4) Additional Supplies added pursuant to Paragraph 29. <br />10. Complete statement of plan for augmentation. <br />A. Historical use of water rights to be used for augmentation: <br />1) Headley Recharge Project Recharge Credits: <br />a) Historically, Pinneo's share of the recharge credits available under the <br />Headley Recharge Project have been used to replace depletions associated <br />with the Headley Wells Nos. 3993-F, 5709-F, and 10794-F attributable to the <br />use of said wells to irrigate up to 470 acres of land in Sections 20 and 29, <br />Township 5 North, Range 55 West, 6th P.M., Morgan County, Colorado, and <br />to replace depletions associated with Gravel Pits Nos. 1, 2, and 4a <br />attributable to evaporation of alluvial ground water exposed in mining <br />activities, and water removed from the property with mined gravel, pursuant <br />to the Headley Recharge Project decree entered November 22, 1992 in Case <br />No. 90CW 189, Water Division No. 1. The midpoint of depletions from the <br />Headley Wells and Gravel Pits reaches the South Platte River at a location in <br />the SW1/4 NE1/4 of Section 33, Township 5 North, Range 55 West, 6th <br />P.M., Morgan County, Colorado. Based on the midpoint of depletions, 40% <br />of the depletions affect the South Platte River upstream of the inlet to the <br />North Sterling Canal and 60% of the depletions affect the river downstream <br />of the inlet to the North Sterling Canal. <br />b) When Pinneo acquired the Headley Farm and a 50% interest in the Headley <br />Recharge Project credits in late 2003, power to Headley Well 10794-F <br />2 Pursuant to Paragraph 31(c) of the Headley Recharge Project decree, recharge deliveries below Antelope Draw are <br />to be allocated pro rata among Headley Recharge Ponds Nos. 1 through 6 according to their relative capacities, <br />unless a particular pond is observed to be dry for an extended period of time. Headley Recharge Ponds Nos. 5 and 6 <br />no longer receive recharge deliveries, and thus deliveries are allocated among the remaining ponds consistent with <br />this provision. <br />12 of 33
