Bear Creek Road Right-of-way COC-66643 <br />Plan of Development <br />Exhibit B <br />Description of the Facility <br />Oxbow Mining, LLC ("OML") wants to use the existing Bear Creek Road to <br />access its private and federal lease-holdings. Right-of-way authorization is <br />requested for an 0.8 mile segment of the existing Bear Creek Road located in <br />Sections 7 and 18, T.13S., R.90W., 6~h PM, which traverses Bureau of Land <br />Management ("BLM") lands before entering private lands of OML and other BLM <br />and private lands contained within OML's federal coal lease COG-61357. These <br />uses include hydrology and subsidence monitoring, exploration and potential <br />future mine ventilation (including methane degasification) in accordance with <br />OML's current approved Colorado Division of Minerals and Geology ("CDMG") <br />permit # C-1981-022, Notice of Intent to explore # CX-2001-223-03, and any <br />future revisions thereto. This road right-of-way will be incorporated into this <br />subject CDMG permit, and OML will provide documentation to that effect. Use of <br />the road by OML would continue for the life-of-mine, as well as any future post- <br />mine reclamation bond release time frame, etc. (or approximately 25+ years). <br />The proposed action is to grant aright-of-way for the portion of the existing road <br />across public land that is off-lease. <br />OML will maintain Bear Creek Road as needed by blading to remove excessive <br />rutting, enhance or repair drainage, remove rocks or other obstructions or similar <br />maintenance activities. Gravel surfacing may be added if needed to provide all- <br />weather access for heavy truck traffic (other than 4- or 6-wheeler and/or %- or'/4- <br />ton pickup trucks). Public access and use of the road has been limited as public <br />access currently terminates at a locked gate to the Hotchkiss Ranches, Inc. <br />("Hotchkiss") property. <br />II. Design Criteria <br />The existing travel surface of the road within the right-of-way is 15 to 20 feet in <br />width with an additional 10 feet of width for embankment and/or cutslopes to <br />provide for drainage (including ditches and/or culverts) where necessary or to <br />minimize road pitch or grade. No change to the current road configuration within <br />the right-of-way is currently planned. The proposed right-of-way width is 30. All <br />maintenance activity will be conducted within the right-of-way limits. <br />OML intends to maintain and repair the road and/or drainage along the Bear <br />Creek Road on private surface and on-lease BLM lands by repairing and/or <br />adding ditches and culverts along the road. On one on-lease segment of road <br />on OML lands located approximately 2.25 miles north of the beginning of the <br />road from Highway 133, the road surface will be widened approximately three <br />feet on the west side for approximately 20 feet. On another on-lease segment of <br />road on BLM lands located approximately 2.7 miles north of the beginning of the <br />road from Highway 133, the road surface will be widened approximately three <br />
