1 V - <br />Exhibit 3 <br />Draft Stipulations for Revised Water Monitoring Plan and EPP to be included as part of <br />approval of M1977-493, AM-06 <br />(1) A Comprehensive Water Monitoring Plan Technical Revision ("Water Plan TR") will <br />be submitted for Division review and approval which satisfies the requirements of <br />Sections 3.1.6, 3.1.7 and 6.4.21(12) of the Hard Rock/Metal Mining Rule. This plan <br />will be incorporated into the permit through the technical revision process that will <br />assure opportunity for meaningful participation by parties identified at the AM-06 <br />pre-hearing conference. <br />(2) A Revised Environmental Protection Plan Technical Revision ("EPP TR') will be <br />submitted for Division review and approval which satisfies the requirements of <br />Section 6.4.21 of the Hard Rock/Metal Mining Rule. This plan will be incorporated <br />into the permit through the technical revision process that will assure opportunity for <br />meaningful participation by parties identified at the AM-06 pre-hearing conference. <br />(3) The Water Plan TR and the EPP TR (the "TRs") will establish permit conditions that, <br />at a minimum, will be protective of the currently prevailing surface water and <br />groundwater conditions, including without limitation the water quality and quantity of <br />Eagle Park Reservoir and Clinton Gulch Reservoir, which collectively meet <br />municipal, domestic, and augmentation water needs for over 124,000 residents and <br />over 7 million skier visits per year. <br />Until both Amendments are approved for incorporation into the permit, the Operator <br />is precluded from placing any additional tailings into the TSFs, operation of the <br />milling facility, mining and/or processing, or any other activities. For purposes of <br />these Stipulations, the term "mining" includes the production, by way of blasting or <br />drilling, of both overburden and ore as well as the relocation or movement of existing <br />overburden or tailings currently residing at the site. Similarly, the term "processing" <br />includes mineral processing, benefication, or any related activities which produce <br />tailings. Ongoing site maintenance, water treatment, and reclamation, which do not <br />pose a risk to prevailing water quality and quantity conditions, will be allowed to <br />continue. <br />The process for reviewing the TRs will adhere to the following steps: <br />• The Operator shall provide the Objectors with complete copies of the Water Plan <br />TR and the EPP TR upon their submission to the Division. The TRs will include <br />a complete list of references including all studies and data that were utilized in the <br />preparation of the TRs, and all reference materials shall be made available to the <br />Objectors upon request. <br />43839
