§4.03 ROADS <br />4.03.3 Light -Use Roads. <br />In 2010, as part of PR -4, Bowie No. 1 will transfer 2,379 acres from their permit boundary to the <br />Bowie No. 2 mine. In addition, Bowie No. 1 agrees that a portion of three Federal Coal Leases <br />will be transferred to the Bowie No.2 Mine. This additional permit area and the Federal Coal <br />Leases will be incorporated into the Bowie No. 2 permit, and will encompass some of the old <br />workings developed from the Bowie No. 1 mine. The Bowie No. 2 Mine has agreed to assume <br />any and all of the liability associated with the old workings that are encompassed by the Bowie <br />No. 2 Mine permit boundary. Additionally, there are several light use roads that will now be <br />incorporated into the Bowie No. 2 permit and the Bowie No. 2 mine will now assume the liability <br />associated with those roads. <br />(1) (a) The Operator currently utilizes light -use roads to access hydrologic and subsidence <br />monitoring stations. The roads have been designed and constructed previously for exploratory <br />drilling, recreational cabin access, and for the existing land use of rangeland. The Operator will <br />construct a light -use road to access the OVWM ventilation shaft and water tank from the West <br />Mine site. <br />One monitoring road accesses the east portion of the permit area (hereinafter referred to as <br />East Road) around the old Farmer's Mine. <br />One monitoring road intercepts Stevens Gulch road north of the Operator's well field and <br />accesses the central portion of the permit area (hereinafter referred to as Central Road) <br />The other monitoring road intercepts Stevens Gulch Road south of the Operator's well field and <br />accesses the western portion of the permit area. <br />All of these roads have been designed and constructed to minimize erosion and siltation, air and <br />water pollution, and damage to property. <br />(b) The light -use roads were field designed and constructed using accepted engineering <br />practices. Appropriate construction techniques and limited use of roads ensure that damage to <br />fish and wildlife resources and suspended solids are minimized. <br />(c) The three light -use monitoring roads have been used at least seven years, and have <br />demonstrated that actual volume, weight, and speed of vehicles can be maintained. Vehicle <br />access, other than wide -tire, all- terrain vehicles, will be restricted on the West Mine fan shaft <br />road, until vegetation is well established and monitoring requirements are reduced. <br />(d) All light -use roads currently being used for cabin access or ranching will not be removed. <br />Such roads will be revegetated to minimize environmental harm. Any light -use road used <br />exclusively for monitoring will be regraded to approximate original contour, if possible, and <br />revegetated. <br />(2) (a) All light -use roads have been located on ridges or on the most stable available slopes to <br />minimize erosion. <br />PR -04 24 06/10 <br />F� PfA <br />1/1-3/// <br />
