At this time, no further <br />disturbance is contemplated over the permit <br />term. <br />• <br />(d) <br />(i) The access roads are existing structures and <br />were designed and constructed using accepted <br />engineering practices. It is believed that <br />vegetation material was removed prior to <br />placement of embankment material. The Orchard <br />Valley Mine facilities access road was con- <br />structed prior to the enactment of the SCMRA <br />and Colorado Coal Mining Act. No topsoil was <br />salvaged from beneath this embankment. <br />Topsoil was salvaged from beneath the other <br />access roads. No vegetation material was <br />placed beneath the other access road embank- <br />ments. <br />(ii) Since the mine facilities access road was <br />built prior to passage of the state and Feder- <br />al mining and reclamation acts and the promul- <br />gation of these regulations, embankments._were <br />not particularly constructed according to the <br />specifications set forth in this section. <br />Maximizing stability of the fill was a con- <br />trolling consideration, however. <br />Standard engineering and construction practice <br />would calf for scarification of natural mater- <br />ial. It may be assumed that this scariFying <br />was done. <br />The other access roads were constructed on <br />slopes of less than lv:3h. The slopes were <br />scarified to ensure bonding of the embankment <br />and natural material. <br />(iii) It is believed that the material for embank- <br />ments was reasonably free of organic material, <br />coal or coal blossom, frozen material, wet or <br />.
