Connell Resources Timnath Pit <br />Spill Prevention Control and Countermeasures Plan <br />Revision Date: June 25, 2009 <br />Section 2.0 Requirements for the Preparation and Implementation of an SPCC Plan [112.3] <br />Page 2-1 <br />Section 2.0 Requirements for the Preparation and Implementation of an SPCC Plan <br />[112.3] <br />The SPCC regulation requires that the Connell prepare and implement an SPCC Plan for <br />the Facility in Fort Collins, Colorado. The SPCC Plan requires a Professional Engineer's <br />certification and management approval. The following sections are included to explain the <br />requirements of the Professional Engineer's certification and management approval as well <br />as provide signature blocks for the relevant personnel to sign the certification and approval <br />statements. <br />The SPCC Plan also requires reviews and amendments. The following sections include the <br />requirements for reviews and amendments as well as forms for documenting reviews and <br />amendments. <br />2.1 SPCC Plan Professional Engineer Certification [112.3(d)] <br />The Professional Engineer certification is included in Appendix E. <br />2.2 SPCC Plan Availability [112.3(e)(1)] <br />The Facility is normally attended for four hours or more a day. Therefore, this SPCC Plan <br />must be maintained on-site and made available to the EPA and other regulator agencies <br />upon request. <br />2.3 SPCC Plan Amendments [112.4 and 112.6(a)] <br />The SPCC Plan may need to be amended to reflect changes at the facility. Additionally, the <br />spill prevention and control measures may need to be revised as a result of spills or due to <br />changes in spill prevention and control technology. The following sections detail the <br />amendment requirements. <br />2.3.1 Amendments Due to Spills 1112.4(a) and (c)] <br />If the Facility has a spill of 1,000 gallons or more of oil into a waterway, or two spills of 42 <br />gallons or greater of oil into a waterway in a twelve month period, the facility is required to <br />submit information to the U.S. Environmental Protection Agency (EPA) Regional <br />Administrator and the Colorado Department of Labor and Employment, Division of Oil and <br />Public Safety (OPS) within 60 days (i.e., 60 days after the spill of 1,000 gallons or the <br />second spill within a twelve month period). The following information should be submitted to <br />the EPA Regional Administrator and OPS: <br />• Name of the facility, <br />• The name of the individual submitting the information,
