Exhibit E - Reclamation Plan, Rule 6.4.5 <br />The reclamation plan states that unsuitable material will be placed inside the northern boundary to adjoin the existing <br />7:1 slope outside the permit boundary. The reclamation map delineates an area that will be graded to match the 7:1 <br />slope. However, no further information is given. Please provide an anticipated maximum acreage of the area or the <br />dimensions of the backfilled pile. This disposal area should also be better depicted on the reclamation map. <br />Exhibit F - Reclamation Map, Rule 6.4.6 <br />The reclamation map does not include the post-mining contours; the stockpiled stone to be processed and a topsoil <br />stockpile are still shown on the site, and there is no indication of the topography of the area to be backfilled along the <br />north side. Please provide a revised map that depicts the site after mining and reclamation are finished. <br />Exhibit I - Soils Information, Rule 6.4.9 <br />The exhibit includes a statement that the available amount of topsoil is limited or non-existent in previously disturbed <br />areas. Please clarify where the disturbed areas are, and whether they lack topsoil. <br />The statement in the previous paragraph does not comport with the description of topsoil (type #142) that is present <br />on the site, which is described as being about a foot deep. Please confirm if this depth estimate is correct. <br />Exhibit J - Vegetation Information, Rule 6.4. 10 <br />The existing patch of Canada thistle is mentioned, and that it will be monitored and treated as necessary until it is <br />gone. Please describe how often it will be monitored and treated, and what the treatment will be. (This weed control <br />plan is best submitted under Exhibit D or E.) <br />Exhibit L - Reclamation Costs, Rule 6.4.12 <br />Please be aware that the costs that will appear in the Division's bond estimate will be higher than those you provided, <br />since it assumes a scenario in which the State hires a reclamation contractor and manages the contract. Tasks that <br />will likely be included in our estimate consist of placing (an estimated volume of) remaining unsuitable stone into the <br />7:1 backfill area; rough grading the site; topsoil replacement; ripping compaction; revegetation of 9.5 acres; and <br />mobilizing a loader and dozer, plus revegetation and weed control equipment, from Naturita. <br />If there are details that could be provided as to different or more efficient, they would be welcomed. This office will <br />estimate the bond amount based on the answers you provide to the questions listed above. <br />Exhibit Q - Proof of Mailing Notices, Rule 6.4.17 <br />The file includes proof of mailing two notices. The one sent to and received by the county commissioners is fine. <br />The other one was mailed to and received by the NRCS, which is a federal USDA agency. The rules require that this <br />notice actually be mailed to the local conservation district, which in this case is the San Miguel Basin Conservation <br />District. Please re-send the notice to the proper office, and provide proof of sending and of receipt. <br />Exhibit R - Proof of Filing with County Clerk and Recorder <br />Your application included sufficient proof of the initial filing. Please be aware that all additional materials that are <br />sent to the Division in response to this letter must be additionally filed at the county clerk, with receipts provided to <br />the Division as proof. <br />Page 3 <br />
