Jared Dains
South Platte Combined Replacement Plan
March 21, 2011
Page 13
5. The applicant may only utilize the 19.6 shares in the Leggett-Owens Ditch and Reservoir in
this plan if all required measurement and bypass structures have been installed and
approved by the water commissioner.
6. The applicant may only utilize the 240 shares of the Boyd & Freeman Ditch in this plan if
accurate measuring and recording devices are installed by April 2011 and those devices are
approved by George Varra, the District 3 Water Commissioner.
7. The total area of pond surface exposed for each of the pits shall not exceed those values
listed in Table 1 of this approval. Should the total surface area exposed exceed those
amounts, an amendment will need to be filed with this office. The total amount of ground
water to be consumed at the gravel mining operations shall not exceed the values listed in
Table 4 of this approval. Should the amount of ground water to be appropriated from each
of the pits exceed the values listed in Table 4, an amendment will need to be filed with this
office.
8. For purposes of this SWSP, if the distance from the surface of the exposed ground
water area to the river was measured based on the down gradient extent of the
exposed ground water surface (nearest point), this method used to measure the
distance to estimate the lagged depletions will be accepted, however any future
SWSP must measure the distance from•the exposed ground water surface area to the
river based on the centroid of the exposed ground water surface.
9. The applicant is seeking to claim credit for water returned to the stream system from
dewatering in excess of the depletions caused by dewatering. Prior to claiming any credit
for the water returned to the stream system from dewatering the applicant must install an
adequate measuring device to measure the quantity of water being pumped for dewatering
purposes.
10. The installation of any device used for measuring replacement water in this plan must be
inspected by a Division 1 hydrographer. Furthermore, the exact location of all return
structures utilized in this plan must be provided to the Division Engineer and Water
Commissioner in order to allow for inspections of the structures. Finally, all charts or other
output data associated with each measuring device utilized in this plan must be provided in
a timely manner acceptable to the Water Commissioner.
11. All diversions shall be measured in a manner acceptable to the Division Engineer. The
Applicant shall install and maintain such measuring devices as required by the Division
Engineer for operation of this SWSP. In addition, the applicant shall maintain daily records
of all diversions, replacements, and the amount of water used for each particular purpose.
The applicant shall provide a report of these records to the division engineer and the water
commissioner on a monthly basis on a form approved by them. The accounting must be
submitted to the division engineer in Greeley (Div1Accountinga-state.co.us) and the water
commissioners Scott Edgar (Scott.Edgar(&state.co.us), George Varra
(George.Varra.a-state.co.us), Shera Sumerford (Shera.Sumerforda-state.co.us), and Bob
Carlson (Bob. Carlsonalstate.co.us) within 30 calendar days of the end of the month for
which the accounting is being made. All amounts shall be in acre-feet.
In addition, the applicant shall submit a report from each entity making replacements; for
this plan, those entities are the City of Westminster, City of Thornton, City of Greeley, Platte
