OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Backfilling & Grading <br />PROBLEM/POSSIBLE VIOLATION: Problem: The pit walls have not been graded to 3H:1V or flatter as mining <br />continues. This is a failure to follow the approved Mining Plan pursuant to C.R.S. 34-32.5-112(1)(c)(vi). <br />CORRECTIVE ACTIONS: The Operator shall either grade the pit walls to 311:1V or flatter by the corrective action <br />date or submit a Technical Revision to change the slope of the pit walls during mining by the corrective action <br />date. <br />CORRECTIVE ACTION DUE DATE: 4/15/11 <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM/POSSIBLE VIOLATION: Problem: Several piles of ground asphalt were noted on the site. This is a <br />problem at this time for failure to dispose of refuse in a manner that controls unsightliness or deleterious <br />effects of such refuse pursuant to C.R.S. 34-32.5-116(4)(e). <br />CORRECTIVE ACTIONS: The operator shall submit a written notice to the Division with photo documentation, <br />that the asphalt has been removed from the site by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 4/15/11 <br />INSPECTION TOPIC: Topsoil <br />PROBLEM/POSSIBLE VIOLATION: Problem: The topsoil stockpiles do not have established vegetation on them <br />and are therefore susceptible to erosion. Rule 3.1.9(1) states if topsoil is not replaced into the backfill area <br />within a time short enough to avoid deterioration of the topsoil, vegetative cover or other means shall be <br />employed so that the topsoil is protected from erosion. <br />Page 1 of 4 <br />
