prior to seeding. A rangeland seed drill will be utilized for seeding most <br />areas. Areas where use of the seed drill may not be practical due to slope <br />or other considerations, they will be hydromulched, or broadcast seeded at <br />twice the normal seeding rate. Seeding will typically be scheduled for late <br />fall, allowing the seed to winter over and germinate in the spring in order to <br />take advantage of elevated soil moisture levels. <br />The coal refuse stockpile is designed to be a permanent structure. <br />Consequently it's design incorporates consideration of long term stability <br />and compatibility of the final configuration and revegetated community with <br />proposed post- mining land uses. As a permanent structure, the coal refuse <br />stockpile was inspected during construction, stability, reclamation and <br />revegetation phases by a registered <br />professional <br />qualified person approved by the DRMS and inspection engineer <br />reports other <br />prepared, certified by a registered engineer and filed with the DRMS within <br />two weeks of the inspection. Quarterly inspections focused on verification <br />that construction and reclamation was consistent with design specifications <br />and identification of any significant indications of instability or surface <br />erosion. <br />Given that the coal refuse stockpile achieved certified stability, reclamation <br />and revegetation in accordance with respective rules and regulations, <br />Technical Revision No. 38 (TR -38) was filed terminating further quarterly <br />inspections and /or report requirements pertaining to the coal refuse <br />stockpile. <br />The stockpile overlies former mine workings. However, it should not be <br />affected by potential subsidence due to specific ground control measures, <br />including barrier pillars and limited extraction, as detailed in the MSHA <br />Roof Control Plan included in Exhibit 16, Roof Control Information. It is <br />anticipated that the coal refuse stockpile will require little or no <br />maintenance. However, if significant surface erosion or indications of <br />instability are observed, EFCI will immediately take appropriate corrective <br />measures to alleviate any problems. <br />The final coal refuse stockpile configuration is an elongated hill <br />2.05.3 -37R Revised December, 2010 (TR -38) <br />
