(e) If Lessee shall default in making any payment or in the performance of any "x <br />obligation hereunder, Lessor shall not be entitled to proceed with any legal remedy therefore unless <br />and until Lessor shall have first given written notice to Lessee of such default sent by certified mail, <br />return receipt requested, and shall have given the opportunity to Lessee to correct same within thirty <br />(30) days following receipt of such notice. <br />(f) Lessor agrees to provide, to and for Lessee, consents to road relocations and <br />closings and any other consents, acknowledgements, affirmations, and waivers and relinquishments <br />required by present and/or future laws (which Lessor is legally capable of providing) to enable Lessee <br />to exercise its Rights and enjoy its leasehold estate hereunder. Lessor agrees to refrain from <br />interfering with, delaying or obstructing Lessee's exercise of any of its Rights hereunder, or similar <br />rights on other lands by any means whatever. <br />(g) Lessor shall pay all taxes and assessments on the property and Lessee shall `X <br />pay all taxes, for or with respect to its equipment and improvements, together with all taxes relating <br />to, or arising by virtue of, Lessee's mining activities. Lessor shall provide evidence to Lessee of <br />payment of all taxes and assessments within 30 days of when such payments became due. If Lessor <br />falls to pay any such taxes, Lessee may pay them and offset such amounts against royalties due to <br />Lessor or may otherwise collect them. <br />8. Lessee's Additignai Commitments <br />(a) Lessee shall reimburse Lessor within thirty (30) days of Lessee's receipt of the <br />notice from Lessor for the annual assessment on the shares of water owned by Lessor and used by <br />Lessee upon the presentation of a paid notice forwarded to Lessee. <br />(b) Lessee shall re-erect the Lessor's property boundary fence removed by Lessee <br />to facilitate mining once the land is released from bond liability by the State of Colorado, Division of <br />Minerals & Geology. All fences shall be replaced with sheep tight woven wire or very similar <br />construction with two strands of barbed wire at the top. Existing cross fences removed by Lessee <br />will be replaced at the time of reclamation if requested by Lessor. <br />(c) Lessee shall reimburse Lessor for any live crop loss due to its activity. This will <br />be a one time one season loss payment. <br />0
