Hickenlooper <br /> Governor <br />DATE: March 7, 2011 Mike King <br /> Executive Director <br />TO: Wally Erickson Loretta Pineda <br /> Director <br />FROM: Peter Hays, Tim Cazier, P.E. <br />RE: Wildcat Mining Corporation, May Day Idaho Mine Complex, File No. M-1981-185, <br />Review of Access Road Geotechnical Stability submittal, dated September 29, 2010, and <br />Mining and Reclamation Plans pertaining to the access road, dated November 10, 2010, <br />for CN-01. <br />History <br />Wildcat Mining Corporation (Wildcat or Applicant) has submitted engineering designs for the access road <br />as part of two previous permit applications, the Idaho Mill (File No. M-2006-069) and Idaho Mine (File No. <br />M-2010-003). The application for M-2006-069 was withdrawn by the Applicant. The application for M- <br />2010-003 was denied by the Division of Reclamation, Mining and Safety (Division or DRMS). The Division <br />reviewed the submitted information and responded with review memos and adequacy letters requesting <br />additional information and details from the Applicant during both permitting processes. The Division <br />previously forwarded six review memos for the access road, written by Allen Sorenson and dated June 5, <br />2009, August 2, 2009, October 28, 2009, May 17, 2010, June 4, 2010 and June 7, 2010. The Applicant <br />failed to address the adequacy issues to the Division's satisfaction and did not comply with the Division's <br />request for a detailed work plan to reconstruct and stabilize the access road. Currently, the Applicant is <br />not approved to utilize the access road due to multiple violations issued by the Mined Land Reclamation <br />Board. The conversion application for the May Day Idaho Mine Complex attempts to permit the access <br />road and allow the Applicant to use the road for site access. <br />Access Road Status Summary <br />As of the date of this memorandum: <br />• The access road cannot be utilized until it is stabilized in accordance with a work plan reviewed <br />and approved by the Division. <br />• No work can be done to stabilize the road until the Division approves engineering design drawings, <br />specifications, and a work plan to address State and County concerns. All documents must be <br />submitted by the Applicant. <br />• The engineering design drawings must present clear intent with respect to road stabilization <br />construction. <br />• The design specifications must be clear and provide standards by which quality control and <br />assurance may be measured and verified. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
